Introduction
PRIMARY PURPOSE OF THIS POSITION Responsible for the effective and efficient management and administration of legal recoveries activities for retail defaulting clients in the non-performing loans book, in compliance with the Bank’s credit policy and procedures. This role involves managing the legal recoveries process, implementing viable strategies to manage the legal process for retail defaulting clients, ensuring compliance with laws and regulations, optimizing debt recovery to achieve organizational goals effectively.
Job description

KEY PERFORMANCE AREAS (KPAS)
 
1.    Financial Management
 
•    Assist Manager: Legal Debt Recovery - Retail with the planning and execution of financial targets related to legal collections.
•    Manage the budget for legal collections activities, including legal fees and other related expenses. 
•    Monitor expenses and ensure they align with the overall financial goals and objectives of the organization. 
•    Ensure the reduction of loss to the Group and increase of revenue through collections and recovery.
•    Manage multiple delinquent accounts though ensuring that no negative impact is caused through IFRIS 9 on the Bank.
 
2.    Legal Collections
2.1    Collection of debts
 
•    Responsible for effective and efficient execution of the debt collection policy, procedures and processes in compliance with the Bank’s credit policy and procedures.
•    Maintain accurate and comprehensive records of all legal collections activities, including communication with debtors, payment arrangements, and legal actions taken. 
•    Implement and maintain the legal collections processes and strategies to enhance efficiency, effectiveness, and compliance. 
•    Implement best practices and innovative approaches to optimize debt recovery outcomes.
•    Ensure that all actions taken in the legal process / collection process is done in compliance with all procedures, processes, legislation, regulations and applicable laws.
 
2.2    Realisation of securities
•    Responsible for effective and efficient realisation of all collateral securities ceded to the Bank in line with the Bank’s policy, procedures as well as applicable.
•    Ensure that all legal actions taken are done in alignment with the Bank’s NPL strategy and all applicable laws and that the assets are realised swiftly with minimum risk to the Bank.
•    Ensure that all collateral securities are legally valid and that they are kept safely in accordance with the Bank’s policy and procedures. 
 
2.3    Auctions

•    Ensure that auctions are effectively and efficiently conducted in liaison with other internal and external stakeholders.
•    Ensure that all processes and procedures are adhered to and that all risks are mitigated to ensure the auction process proceeds with adherence to all legislative and are in accordance with the Bank’s policy and procedures. 

3.    Relationship Management
•    Building and enhance long-term working relationships with both internal and external stakeholders including clients, e.g. attorneys, branches, etc.
•    Enhance and maintain effective and efficient working relationship with existing clients.
•    Provide professional customer service to both internal and external clients at all times.
 
4.    Management of Collateral Documentation 
•    Responsible for effective and efficient administration of agreements and collateral documentation in compliance with the Bank’s policies and procedures. 
 
5.    Compliance, Risk and Support
•    Responsible for effective and efficient administration of legal collection internal processes and procedures in order to ensure compliance with the Bank’s risk framework to minimise risk.
•    Work closely with relevant internal stakeholders such as risk department, internal auditing in managing all risks related to legal collections.
•    Provide support and guidance to various stakeholders such as branches, attorneys, etc. on risk matters related to legal collections.
 
6.    Routine Administration
•    Responsible for effective management and control of all routine administrative activities related to legal collection in the branch in compliance with the Bank’s policies, procedures, rules and regulations.
•    Responsible for effective and efficient management and submission of reports to relevant stakeholders.
 
7.    General
•    Must be prepared /willing to do any other reasonable and lawful instruction/task and ensure that it is normally carried out on time and correct.

Minimum requirements

EXPERIENCE/KNOWLEDGE & SKILLS
•    At least 5 years experience in a legal collection environment.
•    Knowledge of debt collection in a banking environment will be an added advantage.

QUALIFICATION
•    Bachelors’ degree in Law
•    A qualification in the legal debt recoveries / collections.
