Introduction
To provide specialist advice and support to Line Management and Employees in the application of adopted Industrial Relations policies and procedures and Legal requirements. Ensure efficiency in the updating and drafting of Group Policies in alignment with Legislation and best practices. Provide support to Group Companies with the alignments of their respective policies with group policies. Management of Group Industrial Relations schedule determining priorities in terms of the division’s objectives and deadlines that must be met. Total management of the Industrial Relations function of Bank Windhoek and assist the Group Companies as well.
Job description

Key Performance Areas (KPAs)

1.      HR POLICIES

  • Review Group policies to ensure alignment with legislation and best practices ongoing
  • Ensure equitable implementation of the disciplinary and grievance procedures for all employees in the group;
  • Draft relevant policies as needed;
  • Enforcement of Group policies and ensure compliance;
  • Provide support to group companies with the alignment of policies of the group;
  • Provide support on the implementation of policies and guidance as to application of policies;
  • Provide guidance as needed on case law and legislation that may influence policies and business decisions;
  • Fully and always participate with team projects/tasks;
  • Assist with the logistical planning and support for selected meetings & Workshops;
  • Draft and create content for meetings, workshops and training regarding policies and procedures;
  • Accurate and timeous typing of meetings documents;
  • Administration and accurate record keeping of ER documentation as required by Head of Department;
  • Assist Group HR Customers (Subsidiaries- and Associate companies) with disciplinary and grievance processes and taking part in meetings.

2.      Employee Relations

  • Ensure compliance and enforcement of group policies and relevant labour legislation requirements;
  • Represent the company/ management at all conciliation and arbitration proceedings that involve employee relations issues including discipline and grievances at Conciliations, Arbitrations, Trade Unions, Labour Court and Labour Appeal Court;
  • Liaise with Trade Unions and associated social partners;;
  • Liaise with Ministry of Labour and Office of the Labour Commissioner 
  • Advise Line Managers with regard to Labour Relations legislation and employee relations practices;
  • Consult with employees and Line managers regarding labour relations matters i.e. disciplinary and grievance procedures;
  • Monitor disciplinary and grievance enquiries on behalf of the Group, subsidiaries and Associate Companies where required;
  • Oversee disciplinary cases to make sure that there is transparency and fairness when dealing with discipline and also that every disciplinary action complies with the law in terms of substantive and procedural fairness;
  • Provide guidance to HRPB, Forensic and Line Management on charge formulations and suspensions;
  • Provide advisory role to both line managers and employees with regards to disciplinary and grievance issues, employment laws, employee coaching, performance counselling and company policies to minimise outstanding issues and ensure the equitable application of the procedures;
  • Investigates breaches of discipline where required and prepares reports with recommendations;
  • Attend to the final assessment of the recommendations of the Chairpersons after Disciplinary and Grievance hearings to ensure substantive, procedural fairness and consistencies;
  • Attend to the final assessment of the decisions of the Disciplinary Appeal Panels for advice and guidance;
  • Facilitate complex/advanced/high risk cases, the processes and proceedings of:

o   The information meeting in disciplinary cases

o   Consultation sessions

o   Disciplinary, review and grievance processes

o   Appeal hearings for both Disciplinary and Grievance cases

o   Employment relations disputes

  • Liaise between Group Companies and external parties acting on behalf of the company;
  • Consult with Forensic Department on the investigation of cases;
  • Enforcement of Group policies;
  • Assist the business with guidance on the compliance with Labour Legislation and Codes of Good Practices relating to Employment Relations;
  • Develop training material and provide training, guidance and coaching to staff on Labour Law and Industrial Relations matters;
  • Supporting transformation/change management in Industrial Relations cases;
  • Keep abreast with new developments, knowledge and skills in areas of Industrial Relations and Labour Legislation;
  • Assist with wage negotiations.

Minimum requirements

Experience/ Knowledge and Skills
  • At least 2-3 years generalist Human Resources experience, plus at least 5 years relevant experience in an Industrial Relations and Labour Law specialist function
  • Practical knowledge and approach to Policies and procedures in general
  • Good understanding of Labour Legislation and its practical application within the Group
  • Sound understanding and knowledge of Rules and Regulations of the Labour Act  
  • Representation skills in relation to regarding to external dispute resolution, ect Arbitration and Conciliation
  • Computer literacy essential (Word, Excel and Powerpoint)
  • Excellent interpersonal relationship skills
  • Must be able to operate independently on a high level
  • Excellent verbal and written communication proficiency in English
  • Negotiations and Conflict Management skills
Qualification
  • B Degree in Industrial Relations Management with majors in Labour Law and Industrial Relations
  • Law degree or equivalent 
  • Post Graduate Diploma in Law with emphasis on Conciliation and Arbitration will be an advantage
